Equal Housing Opportunity

Federal Fair Housing Act

The Fair Housing Act (Title VIII of the Civil Rights Act of 1968) prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status, and disability.

Protected Classes

Under federal law, it is illegal to discriminate against any person because of:

  • Race or Color
  • National Origin
  • Religion
  • Sex (including gender identity and sexual orientation)
  • Familial Status (families with children under 18, pregnant women, and people securing custody of children)
  • Disability (physical or mental impairment that substantially limits one or more major life activities)

Prohibited Actions

The law makes it illegal to:

  • Refuse to rent or sell housing
  • Refuse to negotiate for housing
  • Make housing unavailable
  • Deny a dwelling
  • Set different terms, conditions or privileges for sale or rental of a dwelling
  • Provide different housing services or facilities
  • Falsely deny that housing is available for inspection, sale, or rental
  • For profit, persuade owners to sell or rent (blockbusting)
  • Deny anyone access to or membership in a facility or service related to the sale or rental of housing

Additional Protections

In addition to federal protections, many states and localities have enacted fair housing laws that provide additional protections. These may include protection based on:

  • Age
  • Marital status
  • Sexual orientation and gender identity
  • Source of income
  • Military or veteran status

  • File a complaint in federal or state court
